GENERAL LIABILITY

General liability (formerly known as the civil liability) insurance contains six liability areas of protection. These include;-

  * Public Liability (including Products and Member to Member Liability). Limit of Indemnity - £10 million pounds

  * Employers Liability. Limit of Indemnity - £10 million pounds (£5 million pounds in respect of Terrorism and/or Asbestos related claims)

  * Professional Indemnity (including Libel and Slander). Limit of Indemnity - £5 million pounds

  * Directors and Officers Liability. Limit of Indemnity - £1 million pounds

As an affiliated club/group, instructor/assistant instructor, welfare officer, secretary and volunteer, NAKMAS requires adequate cover in order to protect your liability. The General Liability will be provided in the name of the Chief Instructor at the club/group and all documentation will be issued in his/her name.

Question: What is Member to Member Liability?

Answer:   Member to Member cover will protect the interests of individual members should an action be brought against them by another member.

Question: What is Public Liability and Products Liability? (PL)

Answer:  As a member, instructor/assistant instructor or club/group of NAKMAS, you have a duty of care to conduct your activities so as to avoid injury to third parties or damage to third party property. If you breach this duty and your actions or lack of actions results in injury or damage, this could constitute negligence and any injured party may well claim damages. Public Liability Insurance provides cover in this respect.

Products Liability protects your legal liability is respect of damage or injury caused by any product sold or supplied by a club or group.

If negligence is proven the Courts would assess the level of damages to be awarded, which would be covered by your Liability insurance, subject to the Limit of Indemnity.

Cover under this insurance facility is automatically provided to all clubs/groups,

instructors and assistant instructors affiliated to NAKMAS.

Question:  What is Employers Liability?

Answer:  Employers Liability insurance is a statutory requirement if you employ any persons under a Contract of Service (paid and unpaid).

The insurance covers legal liability for damages, cost and expenses in respect of Bodily Injury sustained by employees during the course of their employment and in the course of their business.

Cover under this insurance facility is automatically provided to all NAKMAS affiliated clubs/groups, instructors and assistant instructors who may or may not have employees working for them.

Question:  What is Professional Indemnity Insurance? (PI)

Answer:   This insurance indemnifies the insured for breach of professional duty arising from negligent acts, errors or omissions and extends to include libel, slander and defamation.

A breach of Professional Duty can occur from poor coaching or advice, lack of supervision or failure to enforce rules and regulations.

Cover under this insurance facility is automatically provided to all NAKMAS affiliated instructors and assistant instructors teaching within a NAKMAS affiliated club/group or outside of a NAKMAS affiliated clubs/group - worldwide. Welfare officers and secretaries are also covered - worldwide.

Question:  What is Directors and Officers (D&O)

Answer:   Director’s and Officers Liability cover will defend an officer of a club or group for claims made against them for perceived wrongful acts committed by them in respect of contractual and business agreements or improper financial dealings they have committed on behalf of their club or group.

Cover under this insurance facility is automatically provided to all NAKMAS affiliated instructors/assistant instructors teaching within a NAKMAS affiliated club/group. Cover includes protection for Welfare Officers and Secretaries of a NAKMAS affiliated club/group.

Question:  When is cover operative?

Answer:   Cover is operative for all NAKMAS organised activities including for instructors/assistant instructors non NAKMAS activities directly connected to their sport. As an example activities may include:

•Classes and demonstrations

•Teaching and coaching contracts

•Gradings

•Private Tuitions

•Tournaments and events

•Social and fundraising and administration functions*

* Please note that this Insurance facility does not extend to include the ownership, possession or use of aircraft, hovercraft, watercraft (exceeding 8 metre’s in length), or any vehicle.

Cover is provided on a world wide basis subject to policy terms and conditions where the principle exclusion relates to claims bought in a court of law in the USA and Canada. Cover includes USA and Canada where action is brought through a court in the UK.
